JOINT BUSINESS AGREEMENT - TERMS AND CONDITIONS

Government levy/tax

The client will bear the amount attracted as GST/IGST/Surcharge/Cess/ Government taxes and levies on professional fees.

Dispute Resolution

In case the dispute escalates and involves Judicial/Legal intervention/ Arbitration proceedings, then the Court’s decree/ judgment/Arbitration decision, whether in favor of the client or P4’s, shall be deemed as just and fair, and accepted by both parties.

Replacement

P4 Solutions shall provide cost-free resource replacement for the balance days of the guarantee period if-

  • Senior Level Employee quits the job within Three Months or Ninety Days, whichever is earlier
  • Junior Level Employees quits the job within Two Months or Sixty Days, whichever is earlier

Balance Days refers to = Guarantee period less (-) days worked by the client before quitting the job

The above resource replacement condition shall be inoperative if the client terminates the candidate.

But if the client terminates the candidate on the following grounds mentioned below, and informs/communicates P4 Solutions before initiating the termination, P4 shall provide the replacement for the balance period to the client.

  • Integrity
  • Negative Feed Back 
  • Non-compliancy with company norms
  • Fraudulent information served to the company
 

Screening and Reference Check

P4 SOLUTIONS shall conduct the level-1 screening and shall shortlist those candidates for face-to-face interview who clears the eligibility criteria.

P4 SOLUTIONS shall initiate the reference checks on specified candidates, contacting past employers and peer group members in the prescribed format. The details of the reference checks shall be documented and sent to the Client. The company reserves the right to validate the reference check

Police Verification

P4 SOLUTIONS will initiate POLICE VERIFICATION for the candidates residing in Delhi based on the document submitted by the Client/Candidate at a minimum cost of Rs. 4100/- plus taxes, and the expected time involvement is between 21 to 30 days.

P4 Solutions is not accountable or liable to compensate any amount, neither in monetary nor candidate replacement, if the Police Verification exceeds the maximum time frame, as specified above.

P4 SOLUTIONS sponsored Candidates shall be treated as their employees if absorbed for any position by the organization during the next six months.

Our Consulting charges are as follows:

  • Junior Level – 30 days gross salary (Cost To Company).
  • Officer Grade -30 days gross salary (CTC).
  • All Assistant Managers, Managers other than Hr. Manager – 10% of the P.A Gross Salary Package (CTC).
  • Other Sales/Service/Accounts/ Hr Managers, like AGMs, DGMs, GMs, VPs, and CEO – 12% of the P.A Gross salary Package (CTC).

Screening

P4 Solutions shall solely engage in scheduling the interview of the candidates and shall communicate/ convey/ inform the candidates about the interview date, interview venue, interview feedback, and other details related to the interview post-client’s intimation.

The clients must update/ inform P4 Solutions about the interview status, employment affirmation/ rejection/ other matters relating to the employment of candidates.

Offer letter to the candidates

The Client shall inform the candidate, only through P4, about the job confirmation, including the release of the offer letter.

The Client shall provide the details of the compensation offered to the candidate to P4 Solutions.

Billing

P4 solution shall raise the bill for the candidate supply and expects immediate payment within 15-20 days from the date of joining. Statutory tax payments and other surcharges are separate.

Clients are requested to make payments either through –

  • NEFT/ RTGS
  • No Cash payments entertained

Termination of Contract       

This agreement shall stand terminated/ cease to exist upon the performance of either of the following conditions:

(i) Client terminates the agreement by serving two weeks’ notice in advance;

OR

(ii) Both parties mutually agree to end the contractual agreement, serving reason not being mandatory.
